What is Megan’s Law?

As of October 31, 1994, NJ Rev Stat §2C:7-1, et seq., known as Megan’s Law, provides strict registration requirements for those who have committed certain sex offenses. Named after Megan Kanka, Megan’s Law aims to inform community members about sex offenders living in their neighborhood. Megan’s Law allows law enforcement to share sensitive information pertaining to certain sex offenders with the public.

Tier Classification in New Jersey

Sex offenders who committed acts against children will be classified into three tiers. Tier classification and the groups that will be sent notifications for each tier breaks down as follows:

  • Tier 1: The offender is considered to pose a low risk to the community. Law enforcement agencies are notified of the sexual offense.
  • Tier 2*: The offender is considered to pose a moderate risk to the community. In addition to law enforcement, schools, licensed daycare centers, summer camps, and registered community organizations are notified of potential sex offenders.
  • Tier 3*: The offender is considered to pose a high risk to the community. In addition to law enforcement and the community groups mentioned in Tier 2, members of the public will also be notified. A police officer, state trooper, or an investigator from the county prosecutor’s office will deliver notice to each community member door-to-door.

*If you are classified as being under Tier 2 or Tier 3, you will likely be added to the online sex offender registry. When you are listed on the registry, your neighbors will have access to your personal information, criminal conviction, and an identifying photograph. Your personal information will be visible to the public, tarnishing your name forever.

Qualifications for Megan’s Law Removal

Under New Jersey law, a past sex offender will qualify for Megan’s Law removal in the following circumstances:

  • At least 15 years have passed since your conviction or release from prison (whichever is later), and you have not committed any subsequent offenses;
  • Cannot have committed more than one sexual offense;
  • You are not deemed a public threat;
  • Cannot have committed aggravated sexual assault or sexual assault involving sexual penetration under force or coercion.

If you meet the above-listed criteria, the Superior Court of New Jersey will grant you Megan’s Law removal.
