- The victim is at least 16 years old but younger than 18 years old and related by blood or marriage, or the perpetrator has disciplinary power over the victim
- The perpetrator uses coercion or does not have the victim’s permission to commit the act
- The victim is on probation or parole or detained in a hospital, and the accused has disciplinary power over the victim due to their occupational or legal role
- The victim is 13-15 years old, and the accused is at least four years older
- The victim is 18-21 years old, and the perpetrator is a teaching staff member, substitute teacher, bus driver, or other person in a supervisory role
Sexual assault is a second-degree crime, punishable by 5-10 years in prison, a $200,000 fine, sex offender registration under Megan’s Law, and parole supervision for life.
Luring or Enticing a Child
Under the New Jersey Code of Criminal Justice, a person is guilty of luring or enticing a child if he or she attempts, through email, text message, or any other means, to lure a child into a motor vehicle, building, or any isolated area for the purpose of committing a criminal offense. A charge for luring or enticing a child can be charged in conjunction with attempted kidnapping.
Luring or enticing a child is a second-degree crime, punishable by 5-10 years in prison, a fine of $150,000, registration under Megan’s Law, and parole supervision for life.
