If you feel that you or your child’s safety is in danger, you want immediate protection. If you are the victim of domestic violence in the Garden State, you may be eligible to file a temporary restraining order (TPO) at the police station or municipal court at the time of the incident. This allows you to have protection while you wait for your hearing to secure a final restraining order (FRO), which is typically scheduled within 10 days.
If you are seeking protection, our Cherry Hill restraining order attorneys provide everything you need to know regarding restraining orders.
How Do I Get a Restraining Order?
Victims of domestic violence are eligible to apply for a court order to receive protection. Victims can apply for a restraining order at the courthouse or police station, along with filing a criminal report. If you apply at the courthouse, the court clerk or other court staff may be able to assist you in completing an application. If you are requesting the restraining order during court hours, then you should go directly to the Family Division Office at the Superior Court.
Temporary versus Final Restraining Order
If you apply at the police station, an officer will contact the judge to decide if your situation necessitates a temporary restraining order. A TRO will prohibit someone from contacting you until a final restraining order (FRO) hearing is scheduled. Following a TRO, your abuser may be allowed to go back to your residence to gather their belongings.
The FRO will typically be scheduled within 10 days of the issuance of the TRO. At the final restraining order hearing, the judge will hear both sides and issue a decision. The FRO will only be rescheduled if the accused did not receive notice of the hearing. If the accused did receive notice and does not appear, the judge will still issue a decision. The FRO is permanent, so it will remain in effect unless modified by the court.
The FRO can provide additional protections, including a monetary order. This could mandate that the defendant pay alimony or child support or address custody issues. If a FRO is issued by the court, the defendant will be fingerprinted and may need to pay fines and relinquish control of any firearms.
